On Tuesday, April 3, 2018, Josephine County filed suit in federal court against the State of Oregon and Attorney General Ellen F. Rosenblum. The action was brought within the context of recently passed Ordinance 2017-002, which seeks to apply reasonable time, place and manner rules to the production of marijuana in rural residential zones. A group of marijuana producers challenged the ordinance and that case is now pending before the Oregon Court of Appeals.
In the federal case, Josephine County is asking the court to clarify whether the State can lawfully restrict its options regarding land use regulation.
